Closing

Closing is the date everyone has been waiting for and unless you have difficult lawyers or lawyer everyone except the buyer and the seller should stay out of the way, unless they are called upon. When condition dates have been signed off on in timely and professional timelines and no one is being rushed, the closing should be exceptionally smooth. Ask any lawyer, a detailed agreement of purchase and sale is not required until there is a problem, so don’t be afraid of the many pages of conditions and terms in an agreement of purchase and sale. Most of these conditions and terms assist your lawyer and makes his job easier. I have seen it when the better offer is not accepted because representation did not understand the writing of the agreement so they and their seller accept the offer with the least amount of writing thinking it is the most least complicated and easy offer to deal with; well ask any lawyer you don’t need conditions and terms until there is a problem, so make sure your representation has the necessary experience to understand and relate to these more lengthy conditions and agreements. Many of them will be required by financing and if your representative doesn’t understand a clause and its purpose and how it relates to you and the transaction, then they should seek proper advice.
